How to report copyrighted material you believe is being shared through Prod Crate, and how to respond if your file was removed.

Draft — not reviewed by a lawyer

This text is a plain-English draft written by the team, not legal advice, and it has not been reviewed by counsel. Anything in square brackets is still to be decided. It will be replaced with a reviewed version before Prod Crate leaves beta — until then, treat it as a statement of intent rather than a contract.

What Prod Crate is, for this purpose

Prod Crate hosts private sample libraries. Almost nothing in it is public: files are visible to the account that owns them and to anyone that account deliberately shares a link with. We are not a catalogue, a marketplace, or a download site.

We still respond to valid notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512, and we terminate accounts that repeatedly infringe.

Designated agent

Send notices to support@prodcrate.com with "DMCA" in the subject line. [Prod Crate, Inc.], Attn: Copyright Agent, [registered address]. [A designated agent is to be registered with the US Copyright Office before launch; until then this inbox is monitored by the same team.]

Media enquiries are not DMCA notices — those go to press@prodcrate.com.

What a notice must contain

  1. Your physical or electronic signature.
  2. Identification of the work you say has been infringed, or a representative list if there are several.
  3. The share link or other information that lets us find the material — a filename alone is not enough, because we cannot search private libraries on your behalf.
  4. Your address, telephone number, and email address.
  5. A statement that you believe in good faith that the use is not authorised by the owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act for the owner.

A notice missing any of these is not a valid notice, and we will write back asking for the rest rather than acting on it.

What we do with a valid notice

We review it, and where it is valid we disable public access to the material promptly. We then notify the account holder, send them a copy of the notice including your contact details, and tell them how to file a counter-notice.

Counter-notices

If your file was removed and you believe that was a mistake or a misidentification, send us a counter-notice containing your signature, the file and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your contact details, and your consent to the jurisdiction of the federal court for your district — or, if you are outside the United States, [the district in which Prod Crate is located].

We forward the counter-notice to the person who complained. If they do not tell us within 10 to 14 business days that they have filed a court action, we may restore the material.

Repeat infringers

We keep a record of valid notices against each account. An account that accumulates [three] in [12 months] is terminated, and the person is not permitted to open another. Counter-noticed strikes that are not pursued in court do not count.

Only a file someone has actually shared can be the subject of a notice, because only that file is accessible to anyone else. Disabling a share link does not delete the owner's copy of a file, and a notice does not require us to delete their private library.

Misrepresentation

Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing — or that it was removed by mistake — makes you liable for damages, including costs and legal fees. Please be sure before you send.

Other kinds of complaint

Trademark complaints, privacy complaints, and reports of illegal content are not handled by this process. Email support@prodcrate.com and describe the problem; we will route it to the right place.
